Geck Ex Parte Decision, The California Coastal Commission Letter, and Attorney General Bonta's Response

Below is our update thoughts on Judge Geck’s decision yesterday on timeline for Sable’s motion to dismiss and our general thoughts on the response from both the Attorney General and the California Coastal Commission.

Geck Preliminary Injunction Decision

On January 7th, 10:00am Pacific Standard Time (PST) an ex parte hearing was held in Judge Donna Geck’s court where Sable was requesting the motion to dismiss the PI be held in January with petitioners requesting an April hearing.

Geck started the hearing by questioning the appropriateness of ex parte relief in general but opened up arguments from both sides. The result of the scheduling hearing was that the case for dismissal of the PI be heard on February 27th, 2026.

The question on our minds and likely on yours is, why does this Geck PI matter at all? When the entire basis for the PI was based on success on the merits related to state claims that are moot given the PHMSA determination of jurisdiction how can this hold things up?
